By using this website or placing an order with Ammermanbullets.com, you are agreeing to the below statements and terms of sale.

DISCLAIMER: Never point a weapon at anything you do not intend to shoot. It applies at all times, including when loading, unloading, shooting, or laying the weapon down.

NOTICE OF DISCLAIMER OF LIABILITY: Ammerman Manufacturing’s products are purchased “As-Is.” It is important to note that Ammerman Manufacturing is not responsible for any alterations, modifications, careless handling, unreasonable or unsafe use, or neglect. We assume no responsibility for damage and injury caused in whole or part by hand loader, reloader, remanufactured, or defective ammunition. The use of ammunition is dangerous, and by using it, you assume all risk associated with its use to your personal self, equipment, and property damage. We want to make it clear that Ammerman Manufacturing will not be responsible for incidental or consequential damages concerning economic loss or injury to property or persons out of negligence, unsafe handling, alteration, and modifications.



LIMITED WARRANTY: Ammerman Manufacturing’s products are purchased “As-Is.” We only accept returns for damaged or defective products within 30 days from the Purchaser’s original date of purchase. See Returns for complete details.

Ammerman Manufacturing Requirements for Purchasing Ammunition

We ship only to United States citizens and resident aliens that meet all other legal requirements.

By ordering ammunition, you are certifying that you are a U.S. citizen or resident alien and that it is legal for you to receive and possess any products ordered at your shipping address.

Due to the complexity of state and local laws the customer must check to see if a product is legal to import into his or her state and locality.

You have read and agreed to Ammerman Manufacturing, Inc. dba Ammerman Arms Bullets’ Terms & Conditions upon check out.

Federal Age Requirements for Purchasing Ammunition

• Rifle ammunition: You must be at least 18 years to order ammunition for use in a rifle.
• Handgun ammunition: You must be at least 21 years to order ammunition for use in a handgun.

Federal law also prohibits the purchase of ammunition by minors, drug addicts, convicted felons, illegal aliens, the mentally ill and those convicted of a misdemeanor crime of domestic violence.

Additionally, there may be state or local laws that prohibit you from receiving ammunition.

Customer Affidavit

I am not currently less than twenty-one (21) years old.

By selling or delivering ammunition and/or firearms accessories to me, Ammerman Manufacturing, Inc. is not violating any state or local law or ordinance.

I am not under indictment for and have never been convicted in any court of a crime punishable by imprisonment for over one year.

I am not a fugitive from justice.

I am not an unlawful user of addicted to any controlled substance.

I have not been adjudicated as a mental defective and I have not been committed to any mental institution.

I am not an illegal or unlawful alien, and I am not a nonimmigrant alien.

I have never been, and I am not expected to be discharged from the Armed Forces under dishonorable conditions.

I have not renounced my U.S. citizenship.

I am currently not subject to a domestic violence restraining order of any kind.

I have never been, and I am not expected to be convicted in any court of a misdemeanor crime of domestic violence.

I will not conduct an unauthorized export of any defense articles.

Agreement to Indemnify and Defend for Misrepresentation

If any of the above statements under the “Customer Affidavit” section of these Terms and Conditions are untrue, you agree to release, hold harmless, indemnify, and pay to defend Ammerman Manufacturing, Inc. (DBA ammermanbullets.com) and its owners, agents, officers, and employees against any resulting damages, including reasonable attorneys’ fees, civil liability, or criminal prosecution.

Pricing and Availability

While we try and ensure that all details, descriptions, and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered, we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

Shipping

We do our best to ensure that your product reaches your door as quickly and as trouble-free as possible. At checkout, designate the address to which you would like your products shipped. You cannot change this information after checkout. Title to your products will transfer to you once they are delivered to the address you provided at checkout, based on the delivery date and time reflected in the shipping carrier’s records. Once your products are delivered, you assume all responsibility for them, including the risk that they may be stolen or damaged. You release Ammerman Manufacturing, Inc. (DBA ammermanbullets.com) from all liability and responsibility for your products after they are delivered.

Shipping Restrictions

Ammerman Manufacturing, Inc. does not ship outside the United States. Due to Federal, State, and local laws we do not ship to:

• Illinois - Chicago, Deerfield, Cook County
• Massachusetts
• Washington D.C.
• Hawaii
• California - Los Angeles, Oakland, Sacramento, San Francisco, Avalon
• New York - New York City, Manhattan, Bronx, Brooklyn, Queens, Staten Island
• or any other area within the United States where we are prohibited by law from shipping product.

If you attempt to have product shipped to these restricted areas, your order will be cancelled, and you will be subject to the cancellation fee described below.

Incorrect Address

All orders placed have a copy of the order sent to the email address included with that order. Customers must ensure that the order and address is correct. All orders that are returned to us with an invalid shipping address will be charged the full shipping amount that we are billed from the carrier. The Order will then be refunded, minus the shipping amount.

Shipping to Other than Billing Address

Due to the large amount of credit card fraud, we only ship to the Billing Address. If you would like to use a Shipment Address other than the Billing Address, please provide us with a copy of an official statement (utility bill, etc.), Driver’s License or ID with your name and the shipping address shown. Email us a copy and we will update our records to allow you to always use that address. Otherwise, the order will be cancelled if this is not provided within 48 hours and your credit card will be refunded minus a 5% restocking/credit card fee.

Order Cancellation by Customers

We want to provide you with excellent customer service. This includes shipping your order as quickly as possible. Our system is 100% automated, so the moment you place your order our system starts preparing your products to ship. This means that you may not cancel or change your order once it has been submitted. Additionally, for your security, we cannot alter any product information or credit card charges after your order has been submitted.

Order Cancellation by Ammermanbullets.com

We do not like cancelling orders, but we reserve the right to cancel your order if you do not abide by these Terms and Conditions. If we choose to cancel your order, you will receive a refund of the purchase amount less a cancellation fee of $30.00 or 5% of the total purchase amount, whichever is greater.

Refusal to Accept Delivery

By placing an order with Ammermanbullets.com you agree to accept delivery of your order at the shipping address designated at checkout. If you fail or refuse to accept delivery of your order, then you will forfeit the full purchase amount, including all taxes and shipping fees, and be charged for the cost of shipping the order back to our warehouse. To be clear, you will not receive a refund if you fail or refuse to accept delivery of your order.

Returns

Due to the unique nature of the products, we sell, we only accept returns for damaged or defective products. This does not include damage to boxes or packaging, only to the products themselves. Products must be returned within 30 days of your order date.

To initiate a return, please e-mail us at info@ammermanbullets.com so one of our friendly customer experience team members can send you a Return Request form to complete. We will not issue a refund for any products returned to our warehouse that do not have an approved Return Request form on file.

You must complete the Return Request form in full. Any damage must be noted on your form, and you must supply pictures documenting the damage. Once you complete and return the form, we will review it to determine whether, in our discretion, your products are eligible to be returned. If your return is approved, we will send you a pre-paid shipping label so that you can send the damaged products back to our warehouse. You are responsible for properly packing and securing your products to protect them from damage during transit back to us. All returned products are examined upon arrival at our warehouse. Once we receive and examine your return, we will either send you a replacement or issue you appropriate store credit. Only products in new/sellable condition will receive full credit, unless the damage occurred in transit to you, and you properly notified and documented the damage in your Return Request form.

If you decide you want the product back after it has been received at our warehouse, we are happy to collect additional payment from you to cover the costs to ship the product back to you.

Release of Liability and Agreement to Indemnify and Defend

While Ammerman Manufacturing, Inc. (DBA ammermanbullets.com) strives to offer high quality products and excellent customer service. Therefore, you agree that Ammerman Manufacturing, Inc. shall not be liable for any claims or damages, or for the breach of any warranty, express or implied, whether of merchantability or fitness for any purpose or otherwise, in any way related to any of the products listed on Ammermanbullets.com

Furthermore, you understand and acknowledge that Ammerman Manufacturing, Inc. disclaims all liability for the accuracy of information provided to you, and for how you use information provided to you, by Ammerman Manufacturing, Inc. You understand and acknowledge that Ammerman Manufacturing, Inc. cannot be held liable for how you or anyone else uses any information received from Ammerman Manufacturing, Inc. Therefore, you agree to release, hold harmless, indemnify, and pay to defend Ammerman Manufacturing, Inc. and its owners, agents, officers, and employees against any and all damages, including reasonable attorneys’ fees, civil liability, or criminal prosecution arising from or related to your use of information provided Ammerman Manufacturing, Inc.

By placing an order with Ammerman Manufacturing Inc., you agree that you alone are responsible for how the product is used by you or by any other party. You agree to release, hold harmless, indemnify, and pay to defend Ammerman Manufacturing, Inc. and its owners, agents, officers, and employees against any resulting damages, including reasonable attorneys’ fees, civil liability, or criminal prosecution arising from or related to the products you purchase, including but not limited to, the use, storage, or transportation of the product. If any other party files a claim of any kind against Ammerman Manufacturing, Inc. arising out of or relating to your purchase, use, storage, or transportation of products from Ammerman Manufacturing, Inc., you will indemnify and pay to defend Ammerman Manufacturing, Inc. and its owners, agents, officers, and employees against any resulting damages, including reasonable attorneys’ fees, civil liability, or criminal prosecution.

Jurisdiction

You agree that if you choose to file a lawsuit against Ammerman Manufacturing, Inc. or any of its owners, agents, officers, or employees, that lawsuit must be filed in a court located in Harrison County, Kentucky. You agree that any lawsuit filed in any other jurisdiction shall be immediately removed to Harrison County, Kentucky and that you will reimburse Ammerman Manufacturing, Inc. and its owners, agents, officers, and employees for any costs, including reasonable attorneys’ fees, they incur in defending a lawsuit or effecting its removal until the lawsuit is properly before a court in Harrison County, Kentucky.

Governing Law

You agree that Kentucky law will govern (i) your purchase and use of any products from Ammerman Manufacturing, Inc.; (ii) any information you receive from Ammerman Manufacturing, Inc.; (iii) any legal action instituted against  you by Ammerman Manufacturing, Inc.; and (iv) any legal action you institute, or that someone else institutes as a result of your actions, against Ammerman Manufacturing, Inc.

Class Action Waiver

You agree that any dispute resolution proceedings, including litigation, arbitration, or mediation, between you and Ammerman Manufacturing, Inc. will be conducted only on an individual basis and not in a class, consolidated, or representative action. By making this agreement, you acknowledge and affirm that this is a knowing, voluntary, and permanent waiver of your right to bring any claims against Ammerman Manufacturing, Inc. as part of, or on behalf of, any class or any other individuals.

We are not liable for your ordering and obtaining any item on this website that may be prohibited by your laws. Should we be involved in a lawsuit for your ordering products that you are prohibited from having, you will be listed in that lawsuit as well. Your agreement to our policies includes having a valid firearm identification (FID) card or other required permit if your state or locality requires one.

Changes to the Terms

Ammerman Manufacturing, Inc. reserves the right to modify these Terms from time to time at our sole discretion and without any notice. Changes to our Terms become effective on the date they are posted and your continued use of AmmermanBullets.com after any changes to Terms will signify your agreement to be bound by them.
